What Is The Lemon Law?

The Texas Lemon law is a body of law enacted by the Texas Legislature to protect consumer purchasers of defective automobiles and provide them an avenue to seek recovery and/or reimbursement directly from the vehicle manufacturer. If the vehicle meets the requisite repair attempt requirements, or if the vehicle has been out of service for a certain amount of time or poses a serious health and safety risk, you may have legal recourse such as dealership repurchase of the vehicle or monetary damages.
In addition to the Texas Lemon Law, Andy can often assert other causes of action against the manufacturer, including but not limited to Breach of Warranty, Deceptive Trade Practices, and the federal Magnusson Moss Warranty Act. These statutes apply broadly to most consumer law claims and cover the entire duration of a manufacturer’s written warranty. In many instances if your vehicle does not meet the time and mileage requirements of the Texas Lemon Law you still may be able to seek recovery based one or all of these other causes of action.
